Toegang tot recht en effectieve remedies voor kinderen
Het kunnen opeisen van hun rechten en het verkrijgen van rechtsherstel is cruciaal om kinderrechten niet alleen te erkennen, maar ook afdwingbaar te maken. Toegang tot recht is de basis voor de realisatie van alle andere rechten en voor de verantwoording van verplichtingenhouders. Toch stuiten kinderen wereldwijd nog steeds op juridische, procedurele, sociale en structurele obstakels bij het zoeken naar gerechtigheid en effectieve remedies.
Het Comité voor de Rechten van het Kind (CRC) ontwikkelt momenteel een General Comment over het recht van het kind op toegang tot rechtspraak en effectieve remedies. Dit document zal autoritatieve richtlijnen bieden aan staten om wetten, praktijken en mechanismen te ondersteunen en te verbeteren.
Dit webinar wil een publiek debat en bewustwording stimuleren over de belangrijkste thema’s en uitdagingen rondom toegang tot recht voor kinderen. Onder andere onderwerpen zoals gebruikelijke rechtssystemen, kinderen in gewapende conflicten, slachtoffers van (online) seksueel misbruik of geweld, en collectieve schendingen van kinderrechten komen aan bod.

Children’s access to justice and effective remedies
Ensuring that children can claim their rights and obtain redress is central to making children’s rights not only recognized but also enforceable. Access to justice is fundamental for the realization of all other rights and for the accountability of duty bearers. Yet, children around the world continue to face legal, procedural, social, and structural barriers when seeking justice and effective remedies.
The Committee on the Rights of the Child (CRC) is currently developing a General Comment on the right of the child to access justice and effective remedies. This will provide authoritative guidance to States to support the development and implementation of laws, practices, and mechanisms.
This webinar aims to foster public discussion and awareness of key issues and challenges related to children’s access to justice, including customary justice, children in armed conflict, victims of (online) sexual abuse or violence, and collective violations of children’s rights.
